Winter Intention 15 (the "Event")

Release and Waiver

CONDITIONS OF ENTRY

1. All entries are non-refundable and non-transferable;
2. All entrants must complete the official entry form and submit the correct fee in Canadian dollars. There is a twenty-five dollar ($25.00) service charge for NSF cheques;
3. Incorrectly completed entry forms will be discarded or returned and those participants will have to resubmit the forms or leave the Event;
4. Applications for minors will be accepted only with a parent's or legal guardian’s signature and should also be signed by the minor;
5. All entrants must read and sign the Release and Waiver;
6. All entrants must wear their wristband. Do NOT remove the wristband. Failure to wear a wristband
7. may lead to ejection from the Event by organizers;
8. Dogs, skateboards, in-line skates, scooters, roller skis, bicycles and vehicles are strictly prohibited and can only be parked in designated areas if room allows.
9. Smoking is permitted only in designated areas;
10. Alcohol and drugs are not permitted on site;
11. We are collectively responsible for the Zajac Ranch facilities and equipment; participants will be responsible for any damages caused by themselves or their dependents;
12. Leave no trace: You are responsible for your own garbage and recycling. Every item you bring in to camp, you must take away when you leave the land;
13. Use the designated restroom facilities only! People live on this land and drink water from the stream. The forest and the streams are NOT available for bathroom use;
14. Online registrants must read carefully and sign a liability waiver and provide picture identification upon arrival at the camp. Refer to the Registration page on the website to read a copy prior to your arrival. Failure to comply with the conditions above may result in removal of the participant from the site.

By Marking that you have reviewed and agreed to this waiver in the space provided, you agree, warrant and covenant as follows:

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS. BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.

I know that participating in the Event either directly or indirectly as a participant, volunteer, organizer or any other person is a potentially hazardous activity and that I should not participate unless I am medically able to do so as the Event may not be near medical assistance.

I also know that there will be NO police or other security protection at or around the Event. I understand that there may be hazardous terrain, water hazards, fire hazards and fire performances including planned and unplanned fire performances that may be supervised or unsupervised or organized or not by the Event organizers or may be conducted solely by some other Event Participant (s).

I also understand that there may be participants or attendees who are intoxicated or unruly.

I understand that the Event will continue after daylight and I assume all risks associated with participating in the Event, unsupervised at night.

I assume the risk of all of the hazards set out above, which include but are not limited to falls, injury, drowning, contact with other participants or persons whether legal or illegal contact, assault, the effects of the weather including high heat and/or humidity and the condition of the roadways and any land and water, all such risks being known and appreciated by me.

I also understand that there may be mistakes or errors in judgment by the Releasees, including, without limitation, mistakes or errors in judgment that may affect my safety.

Knowing these risks and in consideration of you accepting my entry to take part in this Event, I hereby for myself, my children and our collective heirs, executors, administrators, assigns and anyone else who might claim on my behalf, release, save harmless and indemnify any and all Event organizers, officials, staff, owner and/or lessee of the Event location, Event officials, volunteers any and all sponsors, their respective parent companies, subsidiaries, affiliates, agents, employees, assigns or anyone else acting for or on their behalf (the "Releasees") from and against any and all existing and future claims, actions, costs, expenses and demands in respect to death, injury, damage, loss or expenses, to my person or property, whether foreseen or unforeseen and wheresoever and howsoever caused, arising out of or in the course of my participation in this Event and related events and notwithstanding that the same may have been contributed to or occasioned by any act or failure to act, including without limitation, negligence of the Releasees or any of them.

I willingly consent to the terms of this Agreement even if the Releasees are found in law to be negligent or in breach of a duty of care or any other obligation to me during the course of the Event. 

IN ADDITION, I AGREE TO INDEMNIFY AND HOLD HARMLESS the Releasees from any and all liability, loss, or damages (including legal fees) they may suffer as a result of claims, demands or judgments against them arising out of any injury or damage that I either cause or suffer during my participation and attendance in the Event.

I agree to indemnify and hold each of the Releasees, their respective parent companies, subsidiaries, affiliates, agents, employees, assigns or anyone else acting for or on their behalf harmless from any claim or demand, including reasonable lawyer’s/attorneys' fees, made by any third party due to or arising out of your participation or attendance at the Event or any violation of any term of this Liability Waiver.

In entering into this Agreement I am not relying on any oral, visual or written representations or statements made by the Releasees with respect to the safety or comfort of the Event activities other than what is set forth in this Agreement.

Authority to Register and/or to Act as Agent: You represent and warrant to the Event organizers that you have full legal authority to complete this event registration including full authority to make use of the credit or debit card to which registration fees will be charged. In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. By proceeding with this event registration, you agree that the terms of this Registration Agreement shall apply equally to you and to any third parties for whom you are acting as agent. You represent and warrant that, you are over nineteen (19) years of age, and that if you are registering a minor under (19) years of age you are the parent or legal guardian of such minor, and do hereby consent to the collection of such child's personal information to the extent necessary to enrol in the Event.

Severability:  If any provision of this Liability Waiver shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Liability Waiver and shall not affect the validity and enforceability of any remaining provisions.

I further hereby grant full permission to the Event organizers and participants to use any photographs, videotapes, motion pictures, recordings, or any other record of this event, of me, for any legitimate purpose, without any compensation to me. 

I agree that this Release and Waiver and Conditions of Entry Agreement in all respects by and interpreted exclusively in accordance with, the laws of the Province of British Columbia, Canada and I irrevocably adjourn solely to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada. 

BY MARKING "I have read and understand the waiver for Intention 15" ON THE REGISTRATION FORM I HEREBY ACKNOWLEDGE HAVING READ THIS RELEASE AND WAIVER AND BY ACCEPTING ENTRY INTO THE EVENT AND A WRISTBAND, I UNDERSTAND AND ACCEPT ITS TERMS.
